Terms and Conditions of Entry
PART A – GENERAL TERMS
- Information on how to enter the Brauer Best Dressed NYDA Display – Game of Skill competition (Competition) and prize details form part of these terms and conditions of entry.
- Participation in the Competition constitutes acceptance of these conditions of entry. Entries must comply with these conditions of entry to be valid.
PART B – PROMOTER’S DETAILS
- The Promoter is Brauer Natural Medicine Pty Limited (ABN 85 008 016 242) of 1 Para Road, Tanunda, 5352 (Promoter).
PART C – WHO CAN ENTER
- For the purpose of this competition, the store is considered the entrant.
- Entry is open to all pharmacies and health food stores in Australia.
- Employees of the Promoter or the Promoter’s associated agencies or companies directly involved in the Competition and their immediate family members are ineligible to enter.
PART D – HOW TO ENTER
- The Competition commences on 1st Jan 2025 at 9.00 am Australian Eastern Standard Time (AEST) and entries close on 31st March 2025 at midnight (12.00 am) AEST (Competition Period).
- To enter the Competition, entrants must:
- Contact Brauer Representative or Customer Service (1300 308 108 or custserv@brauer.com.au) to order and receive a Point of Sale (POS) pack and order stock.
- Set up a display in their store as creatively as possible. Using at least 2 types of POS materials and at minimum 1 variant of NYDA SKUs.
- Take a photo of the display and send it to photos@brauer.com.au. Each entry should include entrants store name and contact details.
- Maintain the display for the rest of the competition period.
- Entries must not contain any offensive or inappropriate content. Entrants confirm and promise that their entry is original and does not infringe the rights of any other person.
- Displays are not limited to the use of POS from NYDA, items such as ballons or streamers can be used.
- An entry cannot be modified after it has been submitted.
- The Promoter reserves the right to disqualify any entrant who provides false information or fails to provide information that is reasonably requested by the Promoter. The Promoter reserves the right, in its sole discretion, to refuse to accept entries which are incomplete, indecipherable, offensive, do not comply with these terms and conditions or which contravene any applicable laws or regulations.
- Entry in the Competition is free. Entrants of the Competition are limited to one ‘single’ entry, per entrant. Multiple entries from the same entrant will be disqualified.
- Entries must be received by 31st March 2025 at midnight (12.00 am) AEST. The time of entry will in each case be the time the entry is received by the Promoter’s database. The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries including delays in the delivery due to technical disruptions, network congestion or for any other reason.
- Entries not completed in accordance with these terms and conditions, and any incomplete or indecipherable entries, will be deemed invalid.
- The eligibility of entries is solely within the discretion of the Promoter.
- The Promoter accepts no responsibility for late, lost, misdirected or damaged entries or other communications.
PART E – HOW TO WIN
- All valid entries received during the Competition Period will be assessed at 1 Para Road, Tanunda, 5352 Australia on the following date and time AEST. Draw date 4th April 2025.
- The Competition is a game of skill and chance plays no part in determining the winner.
- Each valid entry will be individually assessed and determined based on its creative merit.
- The best 5 entries as determined by the Promoter or its representatives (Judges) will be deemed the winners.
- The winning entrants will be notified by phone or email within 5 business days after the date of the draw.
- The Promoter’s decision in relation to any aspect of the Competition is final and binding and the Promoter will not enter into any correspondence regarding the result, including in the event of a dispute.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- It is a condition of accepting a prize that the winning entrants must comply with all the conditions of use of the prize and the prize supplier’s requirements.
- Should an entrant’s details change during the Competition Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
- All entrants will receive communication via email containing the winning entrants along with the winning entries.
PART F – PRIZES
- There are five prizes to be won as part of the Competition. Each winning entrant will receive a Prepaid Visa gift card worth $500.
- There will be one prize each per state for Queensland, New South Wales (including the Australian Capital Territory), Victoria and Western Australia. With a further prize shared between South Australia, Northern Territory and Tasmania.
- If there is no entrant for a specific state, the Promoter will use their discretion to select an appropriate entrant from another state.
- Entrants grant the Promoter permission to communicate with them by email and/or telephone in order to provide instructions as to how each winning entrant is to claim their prize and establish their entitlement to it. Each winning entrant will receive their prize within 28 days after the date on which the winners are determined.
- If the prize is unavailable for reasons beyond the Promoter’s control, the Promoter, in its sole discretion, reserves the right to substitute the prize with a prize of equal or greater monetary value, subject to any written directions from a regulatory authority.
- In participating in the Competition, the winning entrants agree to participate and cooperate as required in all editorial and media/PR activities relating to the Competition. Each winner entrant authorises the Promoter to use their details and entry for the purpose of informing the rest of the entrants.
- The Promoter will take all reasonable steps to identify and notify each winner in an attempt to ensure that each winner receives their Prize. However, if a winner cannot be identified or does not claim the Prize within one month of the date on which the winners are determined, their Prize is forfeited and will be awarded to the next best entry.
PART I – NO LIABILITY
- The prizes may come with guarantees from the prize provider that cannot be excluded under the Australian Consumer Law. If those guarantees are not complied with, then you will have rights under the Australian Consumer Law. Subject to those guarantees and rights, the Promoter shall not be liable, and excludes all liability (including negligence), for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the Competition, or the use of any prize, except for any liability which cannot be excluded by law.
- The Promoter and its associated agencies and companies assume no responsibility for any incorrect or inaccurate information, either caused by an entrant or due to any of the equipment or programming associated with or utilised in the Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the Competition including any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
- If for any reason, the Competition is not capable of running as planned (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition), the Promoter reserves the right, in its sole discretion, to disqualify any entrant who undermines the fairness of the competition (by, for example, tampering with, or using or exploiting errors in, the entry process to obtain a competitive advantage over other entrants), to take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to any direction given under state regulations, or any written directions given by a relevant regulatory authority.
- Once each prize has left the Promoter’s premises, the Promoter and its associated agencies take no responsibility for the prizes being damaged, stolen or lost.
- The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- The Promoter will accept no liability for any incorrectly used POS products.
PART J – PRIVACY CONSENT
- All entries remain the property of the Promoter. The Promoter will collect and use each entrant’s personal information for the purposes of:
(a) conducting the Competition (which may include disclosure to third parties for the purpose of processing and conducting the Competition) and for promotional purposes, public statements and advertisements in relation to the Competition;
(b) providing information about the products and services offered by the Promoter and its related companies and its affiliated retailers; and
(c) research to improve its products and services.
- By entering the Competition, entrants consent to the use of their personal information as described in this Part J.
PART K – TERMINATION OF COMPETITION
- The Promoter reserves the right to vary the terms of, or cancel, the Competition at any time without liability to any entrant or other person, subject to applicable laws.
PART L – COMPLAINTS
Any complaints regarding the Competition shall be directed to the Promoter at custserv@brauer.com.au.
